What Happened

On June 18, 2026, FERC issued tailored show cause orders under Section 206 of the Federal Power Act to all six RTOs and ISOs under its jurisdiction: PJM, MISO, SPP, CAISO, ISO-NE, and NYISO. The orders—docket RM26-4, items E-7 through E-12—set two hard deadlines for each grid operator:

  • 30 days (~July 18, 2026): Submit an informational report on how adequate generation will be ensured for existing and new large loads.
  • 60 days (~August 18, 2026): Either justify why current tariffs are just and reasonable without large-load-specific provisions, or file tariff reforms across five categories.

The five reform categories FERC identified:

  1. Efficient transmission service application and study processes
  2. Cost transparency and anti-cost-shifting protections
  3. Accommodation of co-location agreements and behind-the-meter generation
  4. New transmission services for flexible large loads
  5. Study processes for generating facilities serving co-located loads

FERC Chairman Laura V. Swett stated: “We are setting the stage for a resilient, reliable, and forward-thinking grid that empowers communities and safeguards consumers by transforming the way large energy users access the grid.”

What It Means for Your Utility

This is not a rulemaking with a public comment period. It is a show cause order—FERC has already identified potential deficiencies and put the burden on RTOs to defend or fix their tariffs. Every transmission operator and balancing authority inside these six RTO footprints should be watching these dockets now.

Key operational implications:

  • Transmission study queues will shift. If RTOs revise study processes to accommodate large loads, queue position, timing, and cost allocation rules for interconnection planning will change.
  • Co-location and BTM generation rules are in play. Any utility hosting or planning to host data centers, AI compute clusters, or large manufacturing loads should track these proceedings closely.
  • Cost allocation exposure. Anti-cost-shifting provisions could change how transmission upgrade costs are distributed—with direct rate impacts for existing transmission customers.
  • New tariff products may emerge. RTOs filing new “flexible large load” transmission services will create new compliance obligations and potential opportunities for transmission operators.

Running concurrently: NERC’s Level 3 Essential Action Alert on computational loads (issued May 2026) requires all registered entities in the TP, TO, PC, RC, BA, and TOP functional categories to respond via the NERC Alert System by August 3, 2026, midnight Eastern. NERC is assessing implementation of seven near-term reliability mitigation actions through 30 questions. Non-response will be noted in future audit cycles.
